Workers’ Compensation

For decades Tucker Arensberg has protected employers against Workers’ Compensation claims.  Defense of employers against Workers’ Compensation claims includes work for self-insured employers, and service as panel counsel for several insurance carriers.  Dealing with personal injury attorneys who prey on employers and insurance carriers is our specialty.  Our attorneys have handled virtually every kind of Workers’ Compensation claim – from standard wage loss and medical benefit claims associated with workplace injuries, to specific loss claims associated with amputations, scarring and hearing loss, claims involving fatalities, and state and federal black lung benefit claims.

We have a wide range of clients, and a defense coverage footprint that includes the entire state.  Our defense of employers includes clients from the following industries: energy and telecommunications utilities, health care and long term care, retail, and manufacturing.

Over the years, we have established a solid network of medical experts and have perfected the art of reviewing medical records and narrowing the scope of a claim in order to maximize the likelihood of a positive result for our clients.  When the medical evidence presents challenges that would prevent an ideal result, we also work closely with employers in setting up and monitoring restricted duty return to work opportunities in order to avoid scenarios where injured workers drag out the reasonable recovery period for an injury.

An integral part of our practice group is our full-time paralegal, Stacey Sims, whose time is devoted to handling Workers’ Compensation matters.  Given the volume of medical records associated with each Workers’ Compensation claim, Stacey takes the lead in reviewing and analyzing medical records in order to maximize efficiency and minimize costs for our clients.  Stacey’s work also includes contact with medical experts in order to schedule and prepare for independent medical evaluations that play a critical role in defending Workers’ Compensation claims.

We take an aggressive approach in defending Workers’ Compensation claims, but we never “over-lawyer” a case or claim.  We have a refined system and approach for defending claims that has yielded great success for our clients.
