Representative Experience for Manufacturing & Distribution:

  • Representation of international manufacturer of medical equipment in claim against former sales manager for breach of restrictive covenant and theft of trade secrets resulting in injunction barring further solicitation of customers for 18 months.
  • Represented numerous designers and manufacturers of varied consumer and industrial products. Experience with heavy industrial equipment, material handling equipment and consumer products.
  • Regional counsel in Western Pennsylvania and West Virginia for an elevator manufacturer. Trained in aspects of design, manufacture and maintenance of escalator and elevator systems.
  • Prosecution of multi-million-dollar mechanics liens against warehouse and distribution center owners and general contractors.
  • Petition for preliminary injunction against a competitive business in violation of non-compete agreements for large solar installation company.
  • Successfully represented a small manufacturer subject to investigation by the Department of Commerce’s Bureau of Industry & Security for a suspected Export Administration Regulations (EAR) violation.
  • Defended a material manufacturer from claims of defective construction of a short-term parking garage.
  • Represented a pharmaceutical manufacturer in federal MDL proceedings involving claims that the practice of reporting average wholesale prices used for Medicare and Medicaid reimbursement violated federal antitrust and RICO statutes and state unfair competition laws.
  • Defended a pharmaceutical company against claims of price fixing, monopolization and anticompetitive exclusive licensing arrangements in violation of state antitrust and consumer protection laws.
  • Obtained summary judgment on behalf of a chemical manufacturer against tort claims arising from alleged benzene exposure.
  • Obtained a defense verdict for a combustion burner manufacturer after a two-week jury trial in the Superior Court for the County of Los Angeles, California in a case involving contract, negligence and product liability claims.
  • Negotiated a $1 million settlement for a designer and manufacturer of barge haul systems in connection with breach of contract and trade secret claims it asserted against a general contractor/crane designer and related to material handling systems constructed at five United States power plant project sites.
  • After a non-jury trial, enjoined former employees of a steel company subsidiary from violating covenants not-to-compete and unlawful trade secret disclosures.
  • Successfully represented an Amazon.com business that was accused of trademark infringement by a manufacturer of products it was selling.
  • Represented a mid-sized Pennsylvania specialty manufacturing company as general counsel and assisted the company in its exit strategy to be sold to a strategic buyer over a five-year period.
  • Represented a manufacturing company with the successful negotiation of a shareholder dispute and stock purchase.
  • Advised grocery store on ballot referendum question to allow the retail sale of liquor in a “dry” municipality. Following passage of the referendum question, representation included the acquisition and successful transfer of the first retail liquor license to the municipality.
  • Reorganized warehouse distribution business following IRS investigation into improper tax scheme of owners.
