Conference call with Judge Judith Fitzgerald – a retired U.S. Bankruptcy Judge who sat by designation in the District of Delaware – about the state of Third Circuit and Delaware law on postpetition interest rates and its implications for the  Energy Future Holdings dispute.  Judge Fitzgerald, who is currently a professor at Indiana Tech Law School and of counsel at Tucker Arensberg, P.C., has particular familiarity with postpetition interest issues from her experience overseeing the chapter 11 cases of W.R. Grace & Co., in which Judge Fitzgerald issued a key ruling denying certain creditors’ requests for allowance of postpetition interest at the default contract rate – a ruling affirmed by the U.S. District Court for the District of Delaware on appeal.

Judge Fitzgerald is a retired bankruptcy judge with over 25 years judicial experience, having presided over matters in the Western District of Pennsylvania (where she was chief judge for five years) as well as in the District of Delaware (20 years), the Eastern District of Pennsylvania (8 years), and the U.S. Virgin Islands (9 years).  Judge Fitzgerald is currently a professor at Indiana Tech Law School, where she teaches Contracts, Commercial Transactions and Bankruptcy, an is of counsel at Tucker Arensberg, P.C. She previously served as an assistant U.S. attorney and is an elected member of The American Law Institute and a Fellow of the American College of Bankruptcy.
