NEW POSTER REQUIREMENT FOR EMPLOYERS

A new poster has been added to the list of employee rights posters that are already required to be displayed in the workplace.  The new poster relates to the Veterans Benefits Improvement Act of 2004, which amended the Uniform Services Employment and Reemployment Rights Act of 1994 (USERRA) in two ways.  First, it increased the maximum period an employee can continue his or her employer-provided health care coverage from 18 to 24 months.  Second, it requires employers to provide employees with notice of their rights, benefits and obligations under USERRA.

 

To meet the notice requirements, employers must display a poster provided by the Department of Labor in a place that is readily available to all employees.  Additionally, because applicants have rights under USERRA, the poster must be in a place that applicants for employment will see it (such as the room in which they are interviewed) or those rights must be provided to them by way of a handout.   Employers can download the new poster at http://www.dol.gov/vets/programs/userra/poster.pdf or by calling the Department of Labor at 1-866-4-USA-DOL (1-866-487-2365).
