The attorneys of the Business and Estates Group advise clients on matters of franchise law, including the requirements of the Federal Trade Commission as it relates to disclosures from franchisors to prospective franchisees, and the preparation and evaluation of franchise offering circulars, agreements and operating systems. We assist clients in getting franchise systems qualified in different states, where laws governing franchisees very widely, and in obtaining nationwide, tradename, trademark and servicemark, copyright and patent protection where appropriate. We help clients  examine franchising as a method for expanding their existing business as well as those looking to purchase franchise rights in existing systems.

We can help prospective and existing franchisors and franchisees with the various problems that invariably arise after franchise agreements are signed and the franchisor-franchisee relationship develops. Our assistance in this area ranges from counseling as it relates to the rights and duties of the parties under the franchise agreement, working out disputes and litigating, when necessary.
