

Bradley S. Tupi
Bradley S. Tupi, a 1975 graduate
of Columbia College and a 1978 graduate of Columbia University School of
Law, joined Tucker Arensberg in 1990. He is in charge of the firm’s
environmental law practice.
Mr. Tupi began his legal career as an Assistant Corporation Counsel of the City
of New York, where he handled jury trials and administrative proceedings
involving environmental law, the Sabin polio vaccine, medical malpractice, and
many other subjects.
As an in-house attorney at CIBA-GEIGY Corporation (a manufacturer of
pharmaceuticals, pesticides and industrial chemicals), Mr. Tupi defended toxic
tort and product liability suits and pursued insurance coverage for
environmental liabilities.
Brad returned to his native Pittsburgh in 1987, where his practice focuses on
environmental law and litigation. His environmental practice is diverse,
encompassing real estate deals, leaking underground storage tanks, sewer
overflows, regulatory compliance, government enforcement actions, and
litigation. In the litigation arena, Brad has represented lenders,
municipalities, a landfill owner, and a wide array of businesses in cases
ranging from $30,000 disputes over underground storage tank leakage to
multi-million dollar CERCLA suits.
Brad represented several of the firm's municipal clients in negotiations with
EPA, DEP and the Allegheny County Health Department over wet weather sewer
overflow consent orders executed in January 2004. He currently serves as
Solicitor to a water Authority that has constructed a $22 million water system
with DEP grant funds.
Having defended banks in three CERCLA cases, Mr. Tupi has a special interest in
lenders’ environmental risks. He advises banks about the environmental risks in
loans, workouts and foreclosures, and about the opportunities at “brownfield”
sites. He has offered training seminars at several banks, and has helped banks
develop their own environmental due diligence procedures. Brad writes and
lectures frequently about environmental topics affecting lenders.
Brad also maintains an active general litigation practice, including
construction arbitrations and trials, personal injury cases and commercial
litigation.
For example, Brad successfully represented a bank against antitrust and breach
of contract claims following a failed merger. He obtained a compulsory non-suit
at the trial of a $3.2 million construction claim for damages following a
contract termination. He defended personal injury cases involving: a Pittsburgh
firefighter who sustained serious burns after contact with a 23,000 volt
conductor; an infant who claimed permanent neurological injuries as a result of
lead exposure; and a warehouse worker who required a below-the-knee amputation
following an accident with a motorized pallet lift truck.
Brad has authored numerous publications and presentations on subjects including
sewer overflows, environmental law and construction law. He was named a
Pennsylvania Super Lawyer® for 2004 and 2006. He has an AV rating in the
Martindale-Hubbell Law Directory, which is the highest rating for legal ability
and ethical standards awarded by this national lawyer directory.
